Motion to dismiss denied in firefighter’s death


BARNSTABLE, Mass. (WWLP) – Westfield firefighter Kevin Regan was killed one year ago on Cape Cod by an alleged drunk driver. Now a judge has denied the defendants motion to have the case dismissed.
According to Westfield News news media partner WWLP, the defendant, Paul Dennehy of South Yarmouth, asked for the case to be dismissed Barnstable District Court in November. The reason was that the state or police department lost or destroyed his booking video. The court documents state that the video was not backed up and new video was recorded over it. The judge said the loss of the booking video would not deny Dennehy a fair trial. The case will now move toward a trial.
Regan and his fiancé Linda Cavanaugh were struck by Dennehy’s Ford van on December 27, 2014 while they were crossing Route 28 in West Yarmouth. Regan died from his injuries, while Cavanaugh had to be treated at a Boston hospital after she was seriously hurt.
