Attempted murder charged

SOUTHWICK – A Southwick man was held without right to bail and has been arraigned and indicted on charges including attempted murder in Hampden Superior Court after a Southwick officer found him standing over his bloody and beaten wife.
Town police officer Paul Miles reports, in a document filed in Westfield District Court in support of an application for a criminal complaint, that on Friday, Sept. 21, he responded to what he initially thought was a medical call at 6 Lauren Lane and found a resident, Marc H. Belliveau, 37, standing over a woman slumped on her knees who was gagging or vomiting.
Miles reports that, as he approached, Belliveau identified the woman as his wife and immediately indicated that he believed himself to be the aggrieved party in an argument.
Miles immediately locked Belliveau inside his cruiser so that he could care for the woman who he found to be “bleeding heavily from the mouth.”
Miles reports that the woman’s lip was split and her teeth were “knocked back at an unusual angle.” The woman was transported by ambulance to Baystate Medical Center.
Miles wrote that when he approached the house he encountered two small girls coming out of the garage and he led them back inside where he cared for them with another responding officer, Ernest Malone, until their maternal grandfather was able to come to the house to take custody of them.
He reports that one of the girls, aged three, spontaneously said “Daddy hit mommy and then she was bloody.”
The Department of Families and Children was subsequently notified that the children had experienced the incident.
Miles reports that his immediate survey of the residence revealed a pool of blood on the bedroom floor and a blood trail leading to the master bathroom where he observed blood smears on the walls.
Miles next traveled to Baystate Medical Center in Springfield where he was able to speak with the victim who completed an affidavit attesting to the events that led to her injuries.
The woman said in her affidavit that she had been asleep when her husband came into their bedroom and started to choke her.
The victim quotes her husband as saying “I told you I’d kill you and I am.”
She said that her husband choked her until she was almost unconscious but said she “used all my might to turn my body to dislodge his hands” and her husband pulled her into their bathroom where he started to punch her.
The victim said that she did not know how she broke free and ran outside.
Miles reports that he was later informed that the woman’s soft palate had been pushed back so her teeth were out of their sockets and it was unknown if they could be repaired. In addition, surgery was needed to repair her lip that was severely split and disfigured. Miles also found that the hospital staff believed her to have a hairline fracture of her jaw.
Belliveau was initially charged with assault and battery in a domestic relationship and, on the basis of that charge, was released from custody on $100 bail imposed by a clerk magistrate.
The victim sought and was granted an emergency protective order.
On Monday, Sept. 24, Belliveau was arraigned in Westfield District Court on charges of attempted murder and aggravated assault and was held without right to bail pending a dangerousness hearing scheduled for Sept. 27.
At the hearing, Belliveau’s attorney, Colin Keefe of Leeds, stipulated his client’s dangerousness and Belliveau continued to be held without right to bail.
On Monday, Sept. 31, Belliveau appeared before Judge Philip A. Contant and the charges filed in District Court were dismissed because he was indicted and arraigned in Superior Court.
